On September 7, in the dense opening speech of the courts, the president of the Supreme Court explained the worrying situation in which the High Court in particular, and the Spanish Justice in general, finds itself.
Let me highlight a few ideas. The state of the Supreme Court was defined as “devastating”, this calls into question the functioning of our democratic system and contributes to the progressive erosion of fundamental institutions.
Personally, I would have opened the focus and extended these qualifications to the entire Administration of Justice, I would even highlight the speed of erosion . Today, the Fax Lists bleak situation is much more so than a year ago, whether we refer to the reality in which the Supreme Court finds itself, or to Justice in Spain in general.
In the last year, the interim situation in which the General Council of the Judiciary finds itself has not been resolved, and among its multiple consequences, together with interested reforms in the LOPJ, evident difficulties have been generated in making appointments to the Supreme Court. and in other high courts.
The scenario is probably even more dramatic. As I mentioned before, Justice in general has suffered greatly in the last year , it has deteriorated like never before and, on the path it is going, it is heading towards chaos . It is evident, although it seems not enough, that the Administration of Justice is in tatters and no one seems to want to take the necessary measures to resolve it. The problem must be redirected with decisive, firm, transparent, collaborative and realistic proposals that resolve the confusing reality in which we are immersed, and that allow all of us involved to regain sufficient motivation to find effective, consensual and definitive solutions.
Of course, each one to his or her own extent has his or her share of “fault,” but Justice is not in office , it must function day to day, the courts and tribunals must continue to provide legal security to society, and it seems that, in the current political landscape, no one wants to take responsibility for what is happening, not even the Ministry of Justice itself, the first one that should take steps forward to solve the problem it continues to have.
It may be that we will have to agree with those who say that " Justice does not give votes, that is why it is the little sister ." But no one should forget the fundamental role of Justice in our democratic system and guarantees. The inattention and profound abandonment , demonstrated both in the independence of the Judiciary and of the Administration of Justice in absolute terms, shows that the imperative need for Justice to function at the same level is not sufficiently addressed or valued. than other essential public services.
In the current situation of the erosion of Justice, we can ask ourselves , is it really interesting to resolve the situation? When does the Ministry of Justice plan to begin the process of rebuilding the Justice system that it is seeing fall? Are you really interested in Justice functioning, or are you interested in the level of discredit in which you are sinking?
Many questions that have answers only if the Government of Spain wants to decisively confront the situation. We will demand it that way. Let us remember that the true victim of this situation is the defendant , the citizens.
